Who shot Brian Thompson… and why?

So the NYPD, FBI, and Atlanta PD are presently scouring for the cold-blooded killer of UnitedHealthCare CEO Brian Thompson. At this writing, the killer remains unapprehended.

This week, Paul, Chris, and Eric — a combined 80 years of investigatory experience — take a look at the facts worth considering… and how the case will likely be solved (and it will be).

Filling The Void

Truth is, Donald Trump is already president of these United States. This writer has never seen anything like it — and it is a vastly under-commented-upon situation. Our current president is utterly incapable, and as usual: Where is our legacy media?

Right now, Donald Trump is being accorded all the deference of a sitting president — six weeks before the swearing-in. How is it possible that it is DJT representing America at the reopening of Notre Dame? And who already appears to be making foreign policy?

It’s only six more weeks — so Biden will likely make it to the finish line. But this is a terrible optic, and it never should have come to this. And the culprit is the media, followed closely by Jill and Kamala.

This, in fact, should disqualify Kamala from any future office (and Jill from polite company).

Kamala could’ve asserted herself here. She could’ve filled a void that she must have known has been there for at least a couple of years. In fact — she could do it now.

She hasn’t — and she won’t.

Donald Trump is not the only one who dodged a bullet. So did America.


Trial Watch: Daniel Penny

We’ll be delving deeper into the debacle of the Daniel Penny trial in a podcast shortly — but as a quick update, here is what just happened:

  • The Manhattan DA Alvin Bragg went with two charges, Manslaughter 2 and Criminally Negligent Homicide (which is the lower charge);
  • The jury deadlocked on the top charge, and the judge told them, “I cannot let you go on to consider the lower charge unless you find him not guilty on the higher charge” (that’s a quote);
  • Now, this struck me as off — and everyone in the legal community that I’ve spoken to here in NYC feels the same. Even the judge said something like, “Er, I’ll have to consult the case law on this.” Either way, that’s how he left it when he gave the jury the Allen charge, which is essentially a request from the judge to the jury to try again;
  • When they came back deadlocked again, and could not reach any verdict, the judge (and the DA) was in a tough spot. Because they had not found Penny not guilty, by his own words, the judge could not let the jury go on to the lower charge. As such, a mistrial appeared imminent:
  • So that’s when the prosecutor began to scramble, as she saw her case going down in flames. She was apparently frantically calling her higher-ups and the lawyers in the DA’s Appeals Bureau — at which point a DA from the Appeals Bureau showed up and asked the judge to simply throw out the top charge, thereby preserving the case;
  • The judge grabbed this lifeline and managed to remain consistent with his earlier statement by granting this. Now, with no verdict reached on the top charge, he could just throw it out and let the jury continue with the lower charge of Criminally Negligent Homicide on Monday.

Naturally, the defense objected — thereby preserving appeal. The defense’s contention is that such a move is coercive, and tantamount to forcing the jury to reach some sort of a conclusion on the lower charge.

Strangely, the judge seemed to agree on this — but went with the above nonetheless.

Welcome to what passes for criminal process in the great city of New York.

Look for more legal gymnastics this week — before the jury hangs again. After which Bragg will vow to continue his “quest for justice” and will retry this poor kid.

Bragg’s tenure at DANY will go down as a low point in American jurisprudence. He’s such a laughingstock by now, George Soros should ask for his money back.

Oh, and by the way: he’ll be re-elected.

I know it’s a cliche, but: thoughts and prayers for the Thompson family.

And for New York City, which needs them almost as much these days.
